These Terms and Conditions govern the use of the Dictem service (the "Service") provided by CITO GmbH, Jungfrauenthal 8, 20149 Hamburg, Germany ("we"). By using the Service you agree to these Terms.
1. Description of the Service
Dictem is an AI-assisted platform for localizing content. The Service transcribes, translates, voices, and can turn content into songs and videos, and generates accompanying marketing copy. The feature set is under active development (MVP); individual features may change, be added, or be removed.
2. Content rights and acceptable use
You may only upload content for which you hold the necessary rights or are otherwise authorized. You warrant that processing your content does not infringe the rights of third parties (in particular copyright, trademark, or personality rights). Processing copyrighted works of third parties without the corresponding authorization is prohibited.
The content you upload and the results generated from it remain your property or under your rights ownership. We use your content solely to provide the Service.
You are solely responsible for the content you upload and for clearing all rights to it, including the rights to any music, lyrics, voices, names, and likenesses involved. You warrant that you own this content or are authorized to localize it. You agree to indemnify and hold harmless CITO GmbH, its affiliates, and its staff from and against any third-party claims, damages, losses, and costs (including reasonable legal fees) arising out of or related to content you upload, generate, or publish through the Service, or to any breach of the rights warranties above, to the maximum extent permitted by law.
3. AI-generated results
Translations, voice-overs, songs, videos, and marketing copy are produced automatically using AI models. Despite careful implementation, results may contain inaccuracies. You are responsible for reviewing and approving results before publishing them. We do not warrant the factual accuracy, fitness for a particular purpose, or legal admissibility of the results.
4. Availability
We strive for high availability of the Service but do not owe it. Maintenance, further development, and disruptions at integrated third-party providers (e.g. AI API providers) may lead to temporary limitations.
5. Prices
Where paid plans are offered, the prices displayed at the time of order apply. In the MVP stage, features may be provided wholly or partly free of charge; there is no claim to permanent free provision.
6. Liability
We are liable without limitation for intent and gross negligence as well as for damage arising from injury to life, body, or health. For ordinary negligence we are liable only for the breach of an essential contractual obligation (cardinal obligation) and limited in amount to the foreseeable damage typical for this type of contract. Liability is otherwise excluded.
To the maximum extent permitted by law, we accept no liability for content uploaded, generated, or published by you, or for any consequences of its use or distribution; responsibility for such content lies solely with you. The mandatory carve-outs above (intent, gross negligence, and injury to life, body, or health) remain unaffected.
7. Termination
You may stop using the Service at any time. We reserve the right to suspend access in the event of breaches of these Terms, in particular unlawful use.
8. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected. Please direct questions to info@dictem.com.
